  17. <p>     A man's home is his castle, even if home is a park bench or
  18. a cardboard box under a highway bridge. And a man's
  19. possessions, like his home, are protected by the Constitution
  20. from unlawful searches. That was the thrust of a Connecticut
  21. Supreme Court ruling last week that ordered a new trial for
  22. David Mooney, a homeless man charged with murder because his
  23. property--a duffel bag and a box stashed under a ramp leading
  24. onto Interstate 91 in New Haven--had been searched by police
  25. without a warrant. "His duffel bag was luggage," observes
  26. criminal-law professor Lloyd Weinreb of Harvard. "If someone
  27. were walking down the street with a suitcase, everyone would
  28. take it for granted that it was private property." The court
  29. ruled that the bloodstained pants and $700 in coins found in
  30. the bag were inadmissible as evidence.

  32. <p>     In a separate case involving a similar principle, a federal
  33. judge held the city of Miami in contempt of court last week for
  34. destroying bedrolls, clothes and medicine belonging to homeless
  35. people living under a highway overpass. The city was ordered
  36. to pay $2,500 to a homeless shelter.
